The use of Hetzner is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable presentation of our website. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's terminal device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

Data Processing Agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. Storage Duration

General Information on the Legal Basis of Data Processing on This Website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, if special categories of data according to Art. 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also carried out on the basis of Art. 49(1)(a) GDPR. Furthermore, we process your data if this is necessary to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.

Recipients of Personal Data

In the course of our business activities, we work with various external parties. In some cases, it is also necessary to transfer personal data to these external parties. We only pass on personal data to external parties if this is necessary for the performance of a contract, if we are legally obliged to do so (e.g., passing on data to tax authorities), if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR in the transfer, or if another legal basis permits the data transfer. When using data processors, we only pass on personal data of our customers on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL/TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to Promotional Emails

The use of contact data published as part of the legal notice obligation for the purpose of sending unsolicited advertising and information materials is hereby objected to. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam emails.

4. Data Collection on This Website

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of their website – the server log files must be recorded for this purpose.

Inquiries by Email, Phone, or Fax

If you contact us by email, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR, if your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.

The data sent to us via contact inquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after completed processing of your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered into the newsletter registration form is carried out exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke your consent to the storage of data, the email address, and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The legality of data processing operations already carried out remains unaffected by the revocation.

The data you have stored with us for the purpose of subscribing to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after unsubscribing from the newsletter or after the purpose ceases to apply. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6(1)(f) GDPR.

Data stored for other purposes remains unaffected.

After your removal from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage in the blacklist is not limited in time. You can object to storage if your interests outweigh our legitimate interest.

6. Plugins and Tools

Google Fonts (Local Hosting)

This site uses so-called Google Fonts provided by Google for the uniform display of fonts. The Google Fonts are installed locally. A connection to Google servers does not take place.

7. eCommerce and Payment Providers

Processing of Customer and Contract Data

We collect, process, and use personal customer and contract data for the establishment, content arrangement, and modification of our contractual relationships. Personal data on the use of this website (usage data) is collected, processed, and used only insofar as this is necessary to enable the user to use the service or to bill the user. The legal basis for this is Art. 6(1)(b) GDPR.

The collected customer data is deleted after completion of the order or termination of the business relationship and expiration of any existing statutory retention periods. Statutory retention periods remain unaffected.

Shop Orders

When you buy a licence on this website we process the data needed to do so: the product bought, the price, the language of the order, an order number we assign, the time, your email address and name (both passed to us by PayPal after payment), the PayPal transaction references, and the licence ID and licence key issued.

We also store, against each order, your declaration regarding the early lapse of the right of withdrawal: the exact wording you confirmed, the time, and the IP address it was sent from. The legal basis is Art. 6(1)(c) GDPR together with section 356(5) of the German Civil Code: the burden of proving that you made that declaration falls on us, and without storing it we could not discharge it. A purchase through the website is not possible without these details.

The legal basis for the remaining processing is Art. 6(1)(b) GDPR (performance of a contract) and, for invoicing and accounting data, Art. 6(1)(c) GDPR. Order and invoice data are subject to commercial and tax retention periods (section 147 AO, section 257 HGB) and are deleted only once those expire. Licence data is kept beyond that for as long as the licence is valid, so that we can activate it, reset it, and send it to you again if you lose it.

PayPal

Payment is handled by PayPal. For users in Europe the provider is PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.

When you press the buy button, our server creates a payment through PayPal's interface and forwards you to PayPal. You enter your payment details there and only there — we never see them and do not store them. Once payment completes, PayPal sends us the confirmation, the transaction references, the amount, and the payer's email address and name. We need those to issue the licence and send it to the right address: the key is bound to that exact email address.

No connection to PayPal is made from this website until you press the buy button. No PayPal scripts, buttons or counting pixels are embedded.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract). For details of PayPal's own processing and your rights against PayPal see https://www.paypal.com/uk/legalhub/privacy-full.

PayPal also processes data in third countries, in particular the United States. PayPal bases those transfers on the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR).

Sending the Licence Email

Your licence key and the contract confirmation under section 312f BGB are sent by email through a transactional email provider. That provider processes your email address, the content of the message, and technical delivery information (such as whether the message was accepted or bounced). The provider acts as our processor under Art. 28 GDPR and a corresponding agreement is in place. We will name the provider currently in use on request at info@bitgrund.de.

We use such a service because a licence key has to arrive reliably; a licence sitting in a spam folder is a service not rendered. The legal basis is Art. 6(1)(b) GDPR. We send no marketing email by this route.

Affiliate Programme

We run an affiliate programme in which third parties link to our products and receive a commission on sales they refer.

For visitors: attribution works solely through the ?ref= parameter in the address you called up. No cookies are set, nothing is written to local storage, no device fingerprinting takes place, and no profiles are built. There is no access to information on your terminal equipment within the meaning of section 25 TDDDG, which is also why this website has no consent banner. If no purchase happens, the referral is not stored anywhere. If you do buy, the order records which partner referred it — the partner does not learn who you are, only that a sale occurred.

For partners: from participants we process the name, contact email address, the email address of the PayPal account used for payouts, the agreed commission rate, and the referred sales, resulting commissions and payouts. The legal basis is Art. 6(1)(b) GDPR; for payout records Art. 6(1)(c) GDPR applies as well, with the tax retention periods. To make a payout we transmit the PayPal address and the amount to PayPal.

Shop Server Logs

The shop logs technical events so that faults can be traced: the time, order number and outcome of a payment, and for failed logins to the administration area the IP address. To fend off automated access we briefly store counters against IP addresses; these are overwritten once the relevant time window passes. The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the secure and auditable operation of a system that handles payments.

Cookies

This website sets no cookies for visitors. A single cookie is set when the operator signs in to the shop's administration area; it serves only that sign-in, is limited to the session, and is of no relevance to visitors. It is strictly necessary within the meaning of section 25(2)(2) TDDDG and therefore requires no consent.
